The character of Jack Sparrow played by Johnny Depp is the protagonist of Disney's Pirates of the Caribbean saga.

In 2003 they released the first Pirates of the Caribbean film based on a Disney theme park attraction. What certainly stood out most was Johnny Depp's shocking performance as Jack Sparrow, who even went on to be nominated for an Oscar. Although that year it was won by Sean Penn for Mystic River.

The movie Pirates of the Caribbean: The Curse of the Black Pearl was so successful that they have since made four more installments. That's why they are thinking of continuing the saga or restarting it, but without Johnny Depp as Jack Sparrow. Since the actor is facing the film studio for his legal problems with his ex-wife Amber Heard and they do not want him to return to the character ever again. Although if a lawsuit filed by A. Lee Alfred II and Ezequiel Martinez Jr goes ahead, Disney could unfortunately lose the character.

In 2017, Alfred and Martinez sued Disney saying they had stolen their original idea of a genre-challenging pirate in a script they sent to the studio. They claim that some elements of thier story, specifically the role that became Jack Sparrow, were taken from their original idea. At first, the judge dismissed the lawsuit, as Alfred and Martinez's own ideas were taken from famous pirates who existed in reality.

The Court of Appeals has allowed the lawsuit to move forward

Now everything is in a phase that will rely on expert testimony to determine if Jack Sparrow was, in fact, an original character or just someone based on popular pirate themes.

The most curious thing about all this is that Johnny Depp can save Disney. Since he made such a special performance and that at that time the managers did not understand, it can differ substantially in what Alfred and Martinez originally devised.

If it is really confirmed that Disney copied ideas from others, that may mean a compensation worth of millions. So we will have to be attentive to how this matter about Jack Sparrow evolves.
