Nirvana sued by the baby from the album cover photo after 30 years: "I'm Nirvana's baby and it's child pornography!"

Spencer Elden, the baby on the cover of Nirvana's album 'Nevermind', is now 30 years old and has sued the band members. He claims he could not agree to have his picture used as an album cover because he was only four months old.

Spencer Elden, 30, appeared on the cover of Nirvana's 1991 cult album 'Nevermind' as a four-month-old baby. In an interview with The Guardian in 2015, he said that his parents received only $200 for the photo.

"I may have one of the most famous penises in the music industry, but people don't know that when they see me," he said at the time. A year later, he recreated the famous photo in the pool with British photographer John Chapple.

However, it seems that Spencer still thinks that the photo is 'problematic'. TMZ recently released documents from a new federal lawsuit, in which Elden is suing the band and the property of Kurt Cobain for sexual exploitation and child pornography.

"Spencer's true identity and legal name are forever tied to the commercial sexual exploitation he experienced as a minor," Robert Lewis, Elden's attorney, remarked in the lawsuit. 

Namely, he claims that he could not agree to have his picture used as an album cover because he was only four months old and that his legal guardians did not agree to that either. According to documents, Elden believes the photo is actually child pornography.
He added that the band allegedly promised to put a sticker over his genitals, but that was never added to the album cover.
